WE DON’T WANT MORE STAN SWAMY, G.N SAIBABA AND PANDU NAROTE TO BE MURDERED BY THE STATE
CASR DEMANDS IMMEDIATE RELEASE OF FORMER PFI CHAIRMAN E. ABUBACKER AND ACTIVIST A.S ISMAIL ON MEDICAL GROUNDS.
Senior Muslim leaders E Abubacker and A.S Ismail are incarcerated in Tihar jail for more than the past two years under frivolous UAPA charges. Both activists are facing various health ailments but the Judiciary is yet again failing to granted bail on medical ground. Moreover, even basic medical treatment has been denied by authorities in utter violation of fundamental Right to life.
In this month, A.S Ismail suffered a deadly Haemorrhagic stroke inside Tihar central prison leading to complete paralysis in his right side. Although, initially taken to a hospital for treatment after suffering stroke and paralysis, he was forcefully discharged from the hospital and put back in Tihar Jail. The stroke effect is very visible now as his Movement, feeling, chewing, swallowing ability, speech and language, cognitive ability such as thinking, reasoning, memory, and vision all got affected. Paralysis in the right side also worsened, affecting his self-care ability. In this medical condition, he is languishing in Jail without proper medical treatment.
E Abubacker, a 72 years old retired school teacher, journalist and Activist also in Tihar Jail, is facing continuously deteriorating health conditions but hasn’t been granted bail on medical ground till now. Abubacker suffers from multiple serious medical conditions including Parkinson’s disease, diabetes along with hypertension, rare and loss of vision. He has been undergoing intensive medical treatment and care at various hospitals since 2019 when he was diagnosed with a rare a malignant form of cancer ‘Gastroesophagal junction adenocarcinoma’. Although he underwent chemotherapy and surgery in January 2020. He requires a helper while in custody to undertake even basic activities including performing his morning ablutions.
E Abubacker has routinely been taken to various departments in AIIMS DELHI and other hospitals since his arrest and has other wise, frequently been lodged in the jail hospital. Trial court dismissed his bail application while directing that E Abubacker be admitted for medical treat in All India Institute of Medical Sciences. Despite the trial court directions, Abubacker was never admitted in AIIMS until recently and his condition continues to deteriorate in custody.
Medical condition of both activist clearly show deliberate negligence of jail authorities and Judiciary. This is not first time are observing such negligence on part of Investigation Agency, jail authorities and the judiciary. we all know how father Stan Swamy, Pandu Narote, G.N Saibaba were slowly killed by this Hindutva fascist State, by denying them medical care and bail on medical grounds. While father Stan had to fight for something as basic as a sipper, Saibaba for his wheelchair and basic medicines and Pandu Narote died due to deliberate negligence to take him to hospital timely; hardened criminals, rapists and Hindutva Fascists are granted bail and parole at every turn and on every pretext. This is clearly indicative on how law is selectively applied to favour the oppressors and exploiters while those fighting for rights and dignity are made to suffer under that very narrative of “law and order”. We iterate that the oppressed and exploited people will not tolerate another case like Pandu Narote, Stan Swamy and G.N Saibaba.
The Campaign Against State Repression demands immediate release of these two activist. We also appeal democratic and progressive rights organisations and individuals to come together and raise voice against this injustice.
