Brazil: Parliamentarians advance against peasants with anti-occupation project

The parliamentarians involved in the project are at the service of the big landlords. Surveys by portals such as De Olho nos Ruralistas revealed that, among the donors, there are owners of large haciendas accused of invading Indigenous lands.

The Chamber’s Constitution and Justice Committee (CCJ) advanced on July 2 with a project aimed at attacking poor peasants who occupy land across the country. The Project of Law (PL) 4432/2023 seeks to control the data of peasants involved in occupation and is part of a broad offensive by big landlords organized in the Congress.

Control will occur through the so-called “Register of Property Invaders” (CIP), which will systematize data such as full name, tax number, ID, photography and full address of those involved in occupations. The data will be filled out by police officers and inserted into police reports (BO). The author of the project, Rodolfo Nogueira (PL-MS), also proposes that the data be included in criminal records.

The project was not voted because parliamentarians asked for a collective view, but the tendency is that it advances without many obstacles in the CCJ. The project’s rapporteur is the far-right parliamentarian Bia Kicis (PL-DF), and the president of the commission is the far-right deputy, Caroline de Toni (PL-SC).

PL 4432/2023 advances alongside PL 8262/2017, which allows big landlords to call police against occupants even without a judicial warrant, and PL 41832/2023, which is corporatist in character. It requires that popular movements with representation in more than three states have legal personality allowed to operate politically. It is a clear attack against independent movements, which operate independently of the State and bureaucratic bodies.
